Income protection, TPD claims after injury

Did you know that even if you are suffering from a serious injury or illness, like cancer, and it is affecting your ability to return work, you have benefits attached to your superannuation you can claim? Your entitlements can vary from income protection, TPD or a terminal illness payment.

Terminal illness cases

Whilst in most instances terminal illness is defined as having for example less than 12 months to live, however if your prognosis states longer than 12 months you still have the ability to claim TPD insurance. These entitlements can help you move on with your life, pay for medical or physiotherapy expenses.

Turner Freeman Lawyers superannuation law expert can ensure you receive your full entitlements from your superannuation fund if you become injured or ill and unable to work. Adam has found that many of his clients were not aware of their full entitlements and what they could claim for. Or discovered that the payment his clients have received was not the full amount they were entitled to from the start.

TPD claims encompass a variety of illnesses such as cancer, stroke, Alzheimer’s disease, heart attack as an example.

Default standard in Superannuation funds

From the 1st of January 2014, the government has mandated the inclusion of TPD, life insurance and/or terminal illness as a default standard in all superannuation funds. You need to nominate if you do not wish these to be included in your policy.

Whilst this coverage is standard, you will need to ensure you are happy with the level of your cover. All information on your coverage, terms & conditions are stated in your benefit statements and the PDS of your superannuation fund.

If you are unsure of your entitlement, or if your claim has been rejected by your insurer or superannuation fund, give Adam Tayler a call at Turner Freeman Lawyers. He can help bring a claim for you on a No Win No Fee basis.

However there are strict time limits that apply to claims. The process of claiming can be discouraging and overwhelming, but our expert legal advisers are able to make this process more efficient and effective for you.
