Workers Compensation Lawyers Brisbane

Who can make a workers compensation or WorkCover claim?

All employers are required to have workers compensation insurance for their employees in their workplace – because of this, all workers are eligible to access worker’s compensation entitlements if they are injured or ill because of their work regardless of whether they’re full-time, part-time or casual.

Even people who can be considered workers such as volunteers, or those doing work experience will be able to access benefits.

Most Queensland businesses are insured by WorkCover Queensland however, some large employers are self-insured. Your rights and the insurer’s obligations remain the same regardless of whether they are insured by WorkCover or self insured entities.

What am I covered for?

Injuries covered by workers compensation include:

  • Injuries sustained at work
  • Injuries resulting from work
  • Injuries during work activities (for example staff parties)
  • Diseases caused by work
  • Diseases or a pre existing injury made worse by work

What types of injuries can I claim?

Turner Freeman’s Brisbane workers compensation lawyers are experienced in managing work injury claims and WorkCover claims for a wide range of workplace personal injury claims, including:

  • spinal injuries
  • back, neck and head injuries
  • fractures
  • upper and lower limb injuries
  • whiplash
  • soft tissue injuries such as lacerations
  • eye injuries
  • burn injuries
  • repetitive strain injuries
  • Exposure to toxic chemicals
  • shock, anxiety and depression.

What can I claim for?

What you can claim depends on the extent of your injuries. You could be eligible to claim:

  • Lost income
  • Medical expenses and rehabilitation costs
  • Pain and suffering
  • Paid assistance in some circumstances
  • Return to work services

How long will it take?

The majority of workers compensation claims are able to be finalised within six to eighteen months of the claim starting. If your claim proceeds to court, it would add another six to twelve months to the duration of the claim. However, it is highly unlikely that your compensation claim will proceed to court, as most cases claiming workers compensation are resolved prior to this stage.

Frequently asked questions

What can I do if my Workers Compensation claim is rejected?

If your workers compensation claim has been rejected you should seek urgent legal support as strict time limits apply when lodging an appeal. Under normal circumstances, you have three months from the date you received the statement of reasons for the decision that rejected the claim. Lodging an appeal is a legal process for which you will require legal representation.

Will I get into trouble if I lodge a claim against my employer?

There are laws in place to prevent employers from treating an employee differently after they have lodged workers compensation claims. If you have a current workers compensation claim your employer cannot terminate your employment for up to 12 months.

If your employment is terminated or you feel you have been adversely treated due to your workplace injury you should contact a personal injury law firm. Experienced workplace injury lawyers will be able to advise you of your legal rights and what legal action can be taken to protect them.

If I have a Workers Compensation claim, can I also claim for Income Protection?

While it is improbable that you will be able to claim both workers compensation and income protection at the same time, you should be able make a claim for income protection once your workers compensation claim is finished.

The type of income protection you can claim for will depend on what policy you hold with your super.

If you are not able to return to work in your former job you might be eligible for a lump sum payment for permanent impairment. These permanent impairment lump sum compensation payments can range from a modest amount to a very large payment. An experienced lawyer will be able to assist you through the claim process.
