Contract breaches

For many employees, the termination of employment may occur in breach of their contract of employment and may provide a claim for damages.

A breach of contract can occur where an employer does meet its obligations under the contract.

Sub-contractor breach of contract

A breach of contract can arise for example where:

  • wages or other entitlements under the contract are not paid, or not paid in full;
  • entitlements to bonuses, or commissions are not calculated or considered;
  • failure to meet promises of working locations, hours of work and leave entitlements.

The remedies for breach of a contract include an injunction to prevent further breaches and damages.
