Does a will need to be signed by a lawyer in the ACT?
In the ACT, you don’t need a lawyer to sign a will. As long as you sign it in the presence of two valid witnesses, and follow the witnessing rules, your will can be legally valid. If you’re unsure or your situation is complicated, it’s always wise to seek legal advice.
Who can challenge a will in the ACT?
In the ACT, a will can be challenged by certain eligible people, including the deceased’s spouse or domestic partner, children (including stepchildren and adopted children), and anyone who was financially dependent on the deceased or had a close personal relationship with them.
How long do i have to contest a will?
In the ACT, you generally have 6 months from the date probate or letters of administration are granted to file a family provision claim contesting a will.
If you miss this deadline, the court can allow a late application, but only if there are exceptional circumstances and it’s in the interests of justice. It’s best to seek legal advice as soon as possible after the death, as preparing a claim can take time.
