Can’t work after a car accident? How to claim lost income in SA

If you’ve been in a car accident caused by another driver in South Australia, you may be entitled to compensation for lost income due to the accident or resulting injuries. This includes lost wages for time off work due to injury or for attending medical appointments, and future economic losses.

Compensation for past economic loss

You can claim compensation for income lost from the date of the injury until the claim is finalised (excluding the first week of lost earnings).

To prove past economic loss, you’ll need evidence such as payslips, tax returns, and employment contracts. The calculation may be more complex if you’re self-employed, have lost advancement opportunities, or can no longer work overtime hours. It is best to seek advice to ensure that your losses are appropriately calculated.

Additionally, interest and superannuation loss can be claimed on past economic losses. Compensation for past economic loss is subject to a 20% discount rate.

Compensation for future economic loss

A claim for future economic loss compensates you for how your injury will impact your future earning capacity including superannuation. It includes scenarios like working fewer hours, restricted duties, or being unable to return to your previous job. This can be a complex calculation which covers the period between finalisation of your claim and your planned retirement age. A forensic accountant’s report may be required to calculate future economic loss.

To claim future economic loss, you need to meet an Injury Scale (“ISV”) threshold of 8 or higher and an Injury Scale Value (ISV) assessment is likely necessary to determine the severity of your injury and eligibility for compensation.

Compensation for future income loss is also subject to a 20% discount rate.

When do I receive compensation?

Compensation for economic loss is payable as a lump sum on finalisation of your claim. This cannot occur until your injuries have stabilised.
