What should I do if I’ve been unfairly dismissed?

I’m a contractor, am I covered by the same rights as employees?
Not always. Contractors have different rights and obligations. But if you’re being treated like an employee, the law might view you differently. It’s worth getting advice.
How long do I have to make an unfair dismissal claim?
If you’re covered under the Fair Work Act, you usually have 21 days from the date of dismissal to lodge a claim. It’s a tight window, so get advice quickly.
What’s the difference between unfair dismissal and unlawful termination?
Unfair dismissal usually relates to harsh or unreasonable treatment. Unlawful termination covers things like being sacked for discriminatory reasons or exercising a workplace right, like taking parental leave.
Does a restraint meant I can not work in my chosen field?
It depends. Restraints are complex and we suggest obtaining advice in respect of your specific circumstances as sometime a restraint is not enforceable.
Do I need legal advice before signing a contract?
It’s a smart move. Even if the contract seems standard, getting advice upfront can save you a lot of trouble down the track.
What rights do casual employees have?
Casuals aren’t entitled to paid leave, but they still have protection against unfair dismissal and discrimination. Some may also qualify for conversion to permanent employment.
