Does a will need to be signed by a lawyer in Queensland?
No, a will does not need to be signed by a lawyer to be valid in Queensland. To meet the legal requirements under the Succession Act 1981 (Qld), a will must be in writing, signed by you (or by someone at your direction) in the presence of two witnesses, and then signed by both witnesses in your presence. While a lawyer’s involvement isn’t mandatory, getting legal advice can help ensure your will is correctly prepared and avoids potential disputes.
Who can challenge a will in Queensland?
In Queensland, a will can be challenged by certain eligible people, including the deceased’s spouse, de facto partner, children (including stepchildren), and anyone who was financially dependent on the deceased. Challenges are usually made through a family provision claim under the Succession Act 1981 (Qld) if the will does not provide adequate financial support, or by disputing the validity of the will on grounds such as lack of capacity, undue influence, or improper execution.
How long do i have to contest a will?
In Queensland, you generally have 9 months from the date of the deceased’s death to file a family provision claim, but you must give written notice of your intention to contest the will to the executor within 6 months of the death. If these deadlines are missed, the court may refuse your claim unless there are exceptional circumstances and it is in the interests of justice to allow it.
