DVA Claims

If you’ve been injured or fallen ill while on duty, you and your dependents may qualify for various benefits and entitlements.

Several military compensation programs are available to assist personnel who have been injured during their service. These programs are applicable to current and former members of the Australian Defence Force, cadets, cadet officers, cadet instructors, and members of the Australian Federal Police with approved overseas service.

We believe that Australian veterans should receive their full entitlements in return for their service. At Turner Freeman, we have a team of solicitors ready to help you to navigate the DVA system on a “no win no fee” basis.

The specific scheme applicable to you will depend on your service dates and locations. You and your family may qualify for several benefits, including:

  • Medical Expenses
  • Lump sum compensation for permanent injuries
  • Income support if you are unable to work
  • Disability pensions
  • Allowance for home care.

If you are a dependent of an Australian Defence Force member who has passed away due to a service-related condition, you may be eligible to claim compensation. Dependents can include spouses, children, partners, and relatives who require care.

Evidence Required

The system can be challenging to navigate, and you may feel lost about what evidence you need to provide. At Turner Freeman, we will help you at each step of the way, including assisting you with the various claim forms, reviewing your service records and obtaining any medical evidence required to prove your claim.

If you have suffered a noise induced hearing loss, we work closely with audiologists who can arrange free hearing tests to ensure that the evidence in your claim is comprehensive and complete.

Evidence Required

The crucial step in accessing entitlements is for a veteran to submit a claim to have their health condition(s) recognised.

Once a condition is accepted, the veteran will be eligible for appropriate compensation and care based on the condition’s impact on their lifestyle.

Permanent Impairment Claims

DVA permanent impairment claims can be complex, and the right medical evidence must be provided to maximise your entitlements. It’s important that you obtain appropriate legal advice before you submit your evidence to ensure that you are getting what you deserve.

Who can access Allied Health services?

Veterans who have a Gold Card and are seeking to access relevant treatment, are able to utilise the full range of allied health services that are funded by the Department of Veterans Affairs.

White Cards with Accepted Conditions will be able to access services that have been deemed clinically necessary for their specific conditions.

Non-Liability Mental Health White Cards may need to have a referral for specific conditions from a psychologist and general practitioner for specific conditions.

Act Quickly

If you believe you have a claim, remember that there are time limits, and the claims process can be complex. It’s important to seek independent legal advice as soon as possible.

There are strict deadlines for submitting requested information or documentation, as well as for appealing decisions. All correspondence must be acknowledged within 28 days. Failing to meet these deadlines may result in the suspension of your entitlements or the loss of your right to claim compensation.

Contact our team as soon as possible so we can help you understand your situation. We’re here to assist you — reach out online or call us for an obligation free discussion.

Superannuation and Disability Insurance claims

If you are no longer performing your normal work duties as a result of your injury, you may be entitled to a disability benefit through your superannuation fund. We can conduct an obligation-free assessment to find out if you may be entitled to a payment.
